Our total liability to you for all claims arising from your use of the Site shall not exceed the amount you paid to access the Site (which is zero) or one hundred U.S. dollars ($100), whichever is greater.
8. Indemnification
You agree to indemnify, defend, and hold harmless SmartMortgageCalc and its owners, operators, and affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Site; your violation of these Terms; your violation of any rights of a third party; or your submission of inaccurate or fraudulent information to lenders through our lead forms.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
10. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. Material changes will be effective immediately upon posting to the Site with an updated "Last Updated" date. Your continued use of the Site after changes constitutes acceptance of the revised Terms.
11. Termination
We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Site ceases immediately.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
